OVERVIEW

This Term and Condition apply to the POP MART website at https://www.popmart.com/gb, any of its sub-domains and any other websites operated by us or on our behalf and any mobile device application or desktop application developed by us or on our behalf (collectively, the “Platform”); and the digital experiences, membership programs, features, content and other Services accessible through or enabled by the Platform (together with the Platform, the “Services”). is operated by Pop Mart UK Corporation Ltd located at Suite 6.03 Exchange Tower, 2 Harbour Exchange Square, London, England, E14 9GE, together with its affiliates and subsidiaries (collectively as “Pop Mart”, "we", "us", or "our").  In these Terms, “you” or “your” refers to any user of the Platform.

We provide this Platform, including all information, tools and services available on it, to you subject to your acceptance of these Terms and Conditions (“Terms”), as well as any additional terms, conditions and policies referenced herein or made available via hyperlink.

By visiting our site and/or purchasing products from us, you engage in our service and agree to be bound by the following terms and conditions. If you do not agree to these Terms, please do not access the Platform or use any Services provided on the Platform. If these Terms are considered an offer, acceptance is expressly limited to these Terms.

We may, from time to time, add new features, tools or Services to the Site. Any such additions will also be subject to these Terms. The most current version of the Terms is available on this page at any time.

SECTION 1 – GENERAL CONDITION OF USE SITE

1.1 Consumer Only Sales

Pop Mart offers for sale the products available on the Site (the “Products”) and conducts its online sales activities exclusively with customers who purchase the Products through the Site as final “consumers”. For the purpose of these Terms, a “consumer” means any natural person acting for purposes that are outside the scope of their commercial, industrial, craft, or professional activities. Accordingly, any reseller or any intermediary acting on behalf of and for the account of resellers is excluded from the definition of “Customer”.

1.2 Age of Users

By agreeing to these Terms, you represent that you are at least 18 years of age or the age of majority in your jurisdiction of residence.  If you have not reached such age, you may only use the Service with the involvement and consent of your parent or legal guardian.

1.3 Scope of Service: You agree that after registering an account on the site of your designated country/region, the system may enable access to certain global features, shared Services, or cross-border functionalities across the Pop Mart network.

Section 2- USER ACCOUNTS, SECURITY, AND TERMINATION

2.1 Account Creation & Security Responsibilities

To access certain features or Services on the Site, you may be required to set up an account with a username and password. You represent and warrant that all registration and billing information you provide is accurate, current, and complete, and you agree to promptly update such details in your account settings to maintain their accuracy. You are solely responsible for maintaining the confidentiality of your account credentials and for any and all activities that occur under your account. Pop Mart shall not be liable for any loss, theft, or fraudulent use of your account. You agree to notify us immediately of any unauthorized use of your credentials or any other security breach. You may not use anyone else’s account, attempt to gain unauthorized access to the Site, or permit any third party (including minors under your supervision) to use your account; you accept full responsibility for any such unauthorized use.

2.2 Suspension, Termination, and Asset Forfeiture

If we have reasonable grounds to suspect that any information you provided is untrue, inaccurate, or incomplete, or if we believe your conduct violates applicable law, breaches these Terms, or harms our interests, we reserve the right to suspend or terminate your account and cancel any pending orders at our sole discretion without liability. If your account is terminated for a violation, you agree not to attempt to re-register or access the Site under a different identity or account. You may delete your account at any time by following the instructions on the Site or contacting our customer service. Upon any account termination or deletion, and except as otherwise required by applicable law, any promotional points, coupons, or store credits remaining in your account will be permanently forfeited and cannot be recovered.

SECTION 3 - ACCURACY, COMPLETENESS AND TIMELINESS OF INFORMATION

3.1 Product Descriptions and Display Variations

Product images and/or illustrations displayed on the Site or otherwise provided by Pop Mart are for illustrative purposes only and do not form part of the contractual description of the Products. While Pop Mart makes reasonable efforts to ensure that the presentation of the Products on the Site accurately reflects the Products offered for sale, slight variations may occur due to factors such as lighting conditions, photography techniques, shooting angles, display settings, browser configurations, or device characteristics. Pop Mart does not guarantee that the appearance of the Products displayed on your screen will be identical to the actual Products. Such minor variations do not affect the quality, specifications, or conformity of the Products with their descriptions.

3.2 Site Errors, Inaccuracies, and Omissions

We make reasonable efforts to ensure that the information published on the Site is accurate, complete, and up to date. Certain information, including historical or archived content, is provided for reference purposes only and may not reflect the latest information or current circumstances.

Occasionally there may be information on our site or in the Service that contains typographical errors, inaccuracies or omissions that may relate to product descriptions, pricing, promotions, offers, product shipping charges, transit times and availability. Subject to applicable law, we reserve the right to correct any errors, inaccuracies or omissions, and to change or update information or cancel orders if any information in the Service or on any related Platform is inaccurate at any time without prior notice (including after you have submitted your order).  We undertake no obligation to update, amend or clarify information in the Service or on any related Platform, including without limitation, pricing information, except as required by law. No specified update or refresh date applied in the Service or on any related Platform should be taken to indicate that all information in the Service or on any related Platform has been modified or updated.

3.3 Modifications to Service and Availability

We reserve the right to modify, suspend, or discontinue certain features, products, or content of the Service where reasonably necessary and subject to applicable laws and regulations, without affecting orders already accepted. All Products and Services are subject to availability. To ensure better service and availability, we reserve the right, on a case-by-case basis, to limit the sales or quantities of any Products or Services we offer to any person, household, or geographic region.

SECTION 4 - ORDERS PROCESS

4.1 Pre-Contractual Information: Before you enter into a binding contract with us, Pop Mart will provide you, in a clear and comprehensible manner, with all statutory pre-contractual information. This includes the essential characteristics of the products, the total price (inclusive of VAT and all applicable taxes), available payment methods, delivery timeframes, the existence of your 14-day statutory right of cancellation (withdrawal), and your legal guarantee of conformity under the applicable consumer law.

4.2 The Ordering Process

The step-by-step process to place an order on the Platform generally consists of the following steps:

(a) Product Selection: You select products and add them to your shopping cart, where you can review, modify, or delete items at any time.

(b) Checkout Information: You provide your delivery and billing details, and select your preferred payment method.

(c) Order Review: Before confirming your purchase, a summary of your order will be displayed, including the products, quantities, total price (inclusive of VAT), shipping costs, and estimated delivery dates. You will have the opportunity to identify and correct any input errors before submitting your order.

(d) Order Submission: By clicking the button to confirm your order (e.g., "Buy Now" or "Pay Now"), you submit a binding offer to purchase the products subject to these Terms.

(e)Order Acknowledgement: POP MART will send you an automated email acknowledging receipt of your order. Please note that this email is an acknowledgement only and does not constitute our legal acceptance of your order.

4.3 Contract Formation and Right to Refuse Orders

The presentation of products in our online shop does not constitute a legally binding offer, but an invitation to place an order. A legally binding contract between POP MART and you is only formed when we expressly accept your order by sending you a separate email confirming that the products have been dispatched ("Dispatch Confirmation"). Pop Mart reserves the right to refuse or cancel an order prior to the conclusion of the contract for any legitimate reason and in accordance with applicable laws and regulations. In such instances, POP MART will notify you without undue delay and fully refund any amounts paid, with no additional cost to you.

4.4 Irregular Orders and Misconduct

To ensure a fair and secure shopping environment, Pop Mart reserves the absolute right to limit quantities, cancel orders, reject returns, or suspend your account if we detect any suspicious or abusive activity. Prohibited behaviors include, but are not limited to:

·         Using automated tools, software, or scripts to bypass purchase limits, secure stock, or unfairly claim discounts;

·         Placing multiple or repetitive orders to hoard limited-edition Products, either through a single account or multiple associated accounts;

·         Creating or using multiple accounts linked by the same, similar, or fake shipping addresses, names, phone numbers, payment profiles, or IP addresses;

·         Buying in bulk combined with an abnormally high rate of returns or refunds, or frequently demanding refunds without a valid reason;

·         Requesting refunds for products you did not actually return to us, products not purchased from Pop Mart, or attempting to return fake or substituted items.

SECTION 4A - SPECIAL ORDERING FEATURE: POP NOW ONLINE UNBOXING

4A.1 Overview and Nature of Service

POP NOW is a specialized purchasing feature that combines an immediate digital reveal service with subsequent physical product delivery. By selecting and completing payment for a POP NOW order, you explicitly request and agree to the immediate performance of our online reveal service, allowing you to instantly unlock and identify the hidden blind box figure on your screen prior to physical shipment.

4A.2 Exclusion of the Statutory Right of Cancellation (Withdrawal)

In accordance with Regulation 36 of the UK Consumer Contracts Regulations 2013 (for UK customers), once the online reveal animation is completed, the digital service is fully performed and the surprise element of the blind box is permanently consumed. Consequently: (a) You acknowledge and agree that your standard 14-day statutory right of cancellation (cooling-off period) under Regulation 30 of the UK CCRs is fully exhausted and no longer applies upon completion of the online reveal. (b) Orders unboxed via POP NOW are non-returnable and non-refundable for a change of mind.

4A.3 Dispatch and Shipping Rules for POP NOW

(a) POP NOW items are purchased and shipped separately from other products, and cannot be combined with other items to qualify for free shipping.

(b) Manual Dispatch Request: Payment completion for a POP NOW order does not trigger automatic physical dispatch. Following the online reveal, you must log into 'My Account' and manually submit a dispatch request within thirty (30) calendar days.

(c) Automatic Dispatch: If no manual dispatch request is submitted within thirty (30) calendar days from payment, Pop Mart will automatically process and ship your order to your default shipping address saved in the system.

4A.4 Preservation of Statutory Rights for Defective Goods

Nothing in this Section 4A affects your statutory rights regarding faulty, damaged, or misdescribed goods under the UK Consumer Rights Act 2015, or applicable local mandatory consumer protection laws. If your physical product arrives damaged, defective, or non-conforming, you remain fully entitled to statutory remedies, including repair, replacement, or refund.

4A.5 All POP NOW orders, whether purchasing a single box or a full set, consist of individually sealed boxes.

SECTION 5 - PRICE AND PAYMENT

5.1. All prices displayed on the Platform are indicated in British Pounds (GBP / £) and are inclusive of United Kingdom Value Added Tax (VAT) at the applicable current rate. Shipping costs, where not included in the product price, will be clearly itemized and displayed to you before you confirm and submit your order.

5.2. POP MART reserves the right to modify the prices of products on the Platform at any time. Such price modifications will not affect orders for which an Order Acknowledgement email has already been sent pursuant to Clause 5, which shall be governed by the price in effect at the time the order was placed.

5.3. POP MART makes every effort to ensure that all information regarding products, prices, and availability on the Platform is accurate. While we take reasonable care to ensure that all prices displayed on our Site are accurate, errors may occasionally occur. If the correct price of a Product on the date you place your order is higher than the price displayed, we will contact you before accepting your order and provide you with the option to proceed with the purchase at the correct price or cancel your order. If we have accepted and processed your order, and the displayed price was subject to a material, obvious, and reasonably identifiable pricing error that you should have been aware of, we reserve the right to terminate the Contract. In such circumstances, we will refund all amounts paid by you and provide appropriate instructions for the return of any products delivered.

5.4 When you provide payment information, you represent and warrant that the information is accurate, that you are authorized to use the payment method provided, and that you will notify us of changes to the payment information. We reserve the right to utilize third party payment card updating services to obtain current expiration dates on credit cards and debit cards.

SECTION 6- PRODUCT DELIVERY

6.1. Where the Customer requests delivery to a designated address, delivery will be fulfilled within the timeframe agreed during the Order Confirmation, subject to full clearance of payment. Please note that any delivery dates or times provided are estimates only and are not guaranteed.

6.2. Delivery is handled by third-party carriers. Shipping fees are not included in the product price; they are calculated and displayed separately in the order summary before checkout and shall be borne by the Customer, unless a promotional free-shipping offer applies at Pop Mart’s sole discretion. Shipping and tracking details will be sent to the email address provided in the order form.

6.3. To the maximum extent permitted by applicable law, Pop Mart accepts no liability for any loss, damage, or delivery failures resulting from separate arrangements made directly between the Customer and the carrier.

6.4. Upon delivery or in-store pickup, the Customer is strongly encouraged to inspect the packaging for any visible damage or tampering, and to verify that the Products match the delivery note and the ordered specifications (model, size, color, quantity). Any visible damage or discrepancy should be noted on the carrier’s delivery receipt before signing, and reported to Pop Mart Customer Service without delay. Pop Mart reserves the right to reject cosmetic or discrepancies claims raised after signing without notation, without prejudice to your statutory rights regarding product conformity.

6.5. Both the statutory title to (ownership of) and the risk of loss or damage to the Products shall pass to the Customer at the exact time the Products are delivered to the agreed address or collected from the selected retail store.

SECTION 7 - RIGHT OF CANCELLATION (STATUTORY COOLING-OFF PERIOD)

7.1. As a consumer, you have a statutory right to cancel your order for any reason within a 14-day cooling-off period, without providing any justification. This period expires 14 days from (i) the date you or your designated third party (other than the carrier) takes physical possession of the Products, or (ii) the date of in-store collection. If your order contains multiple Products delivered separately, the period runs from the delivery of the final item.

7.2. To exercise your right to cancel, you must explicitly inform Pop Mart of your decision within the 14-day window. You may easily do so by clicking the dedicated "Cancel Order / Right of Withdrawal" button available prominently on our Site, which allows you to submit a digital cancellation declaration instantly. Alternatively, you may notify us by contacting Customer Service or by submitting the standard cancellation form provided under the "Customer Service" section of our Site. It is not necessary to give us any reason for invoking your statutory right of withdrawal.

7.3. Blind Box & Sealed Product Exclusions: In alignment with consumer protection laws regarding sealed goods, the right of cancellation does not apply to the specific products or gameplay experiences listed below (for detailed terms governing these specialized features, please refer to their respective Special Service Terms and Conditions):

(i) Sealed Products that have been opened, unsealed, or tampered with after delivery (including but not limited to blind boxes, mystery packaging, and sealed collectible foils), where the nature of the product prevents it from being resold once opened;

(ii) Products unsuitable for return due to health protection or hygiene reasons if unsealed;

(iii) Bespoke, made-to-order, or clearly personalized items.

(iv) Products purchased and unboxed via the POP NOW feature, as detailed in Section 4A (Special Service Terms - POP NOW Online Unboxing Feature).

7.4. Return and Refund Conditions: Pop Mart will process your cancellation refund provided that: (i) the Products are returned unopened, unused, untampered with, and in their original resalable condition; (ii) all original components, including blind box character ID cards, original tags, accessories, and packaging materials, are completely intact; and (iii) the Products are sent back in their original, undamaged outer box.

7.5. Processing of Refunds: If you cancel this contract, we will reimburse all payments received from you, including standard delivery costs (except for any supplementary costs arising if you chose a delivery method other than our least expensive standard delivery). You must bear the direct cost of returning the Products. Refunds will be processed within 14 days of Pop Mart receiving the returned goods or receiving proof of return, whichever is earlier. Reimbursements will be issued using the same payment method as the initial transaction, and you will not incur any fees for the refund.

SECTION 8 - STATUTORY RIGHTS AND LEGAL GUARANTEES

8.1. Under applicable consumer laws, all Products supplied by Pop Mart must be of satisfactory quality, fit for purpose, and as described. If the Products delivered do not conform to these legal requirements, the Customer is entitled to statutory remedies at no additional cost.

8.2. Resolution Process for Defective Goods:

·         Short-Term Rejection: If the Product is faulty or does not match the description upon delivery, you have a legal right to reject the goods within a reasonable statutory timeframe and claim a full refund.

·         Repair or Replacement: If a defect appears after this initial period, you have the right to request a repair or replacement. If the repair or replacement is unsuccessful, impossible, or disproportionately inconvenient to you, you are entitled to an appropriate price reduction or a final right to reject the Product for a refund.

·         Time Limitations: Your rights regarding product defects remain protected under the statutory limitation periods applicable in your jurisdiction.

8.3. These legal rights apply strictly to manufacturing defects or non-conformity under normal, intended use. They operate completely independently of, and are not restricted by, any commercial warranties or standard return policies offered on the Site.

SECTION 9 - OPTIONAL TOOLS

We may provide you with access to third-party tools over which we neither monitor nor have any control nor input.  You acknowledge and agree that we provide access to such tools “as is” and “as available” without any warranties, representations or conditions of any kind and without any endorsement. We shall have no liability whatsoever arising from or relating to your use of optional third-party tools.  Any use by you of optional tools offered through the site is entirely at your own risk and discretion and you should ensure that you are familiar with and approve of the terms on which tools are provided by the relevant third-party provider(s).  We may also, in the future, offer new Services and/or features through the Platform (including, the release of new tools and resources). Such new features and/or Services shall also be subject to these Terms.

SECTION 10 - THIRD-PARTY LINKS

Certain content, products, Services, or materials available via our Service may be provided or made available by third parties. Our Service may also include links to third-party Platforms which are not operated or controlled by us. We do not control, monitor, or evaluate third-party content, Platforms, or Services, and do not guarantee their accuracy, completeness, or reliability. We are not responsible for any third-party content, Platforms, products, or Services, or for any transactions or interactions you may enter into with third parties. Any reliance on third-party content or Services is at your own discretion.

Third-party links are provided for convenience only and do not constitute an endorsement or approval of such Platforms or their content. You should review the applicable terms, policies, and practices of any third-party provider before engaging in any transaction, and any complaints or issues relating to third-party products or Services should be addressed directly to the relevant third party.

SECTION 11 - USER COMMENTSAND OTHER SUBMISSIONS

If at our request, you send certain specific submissions (for example contest entries) or without a request from us you send creative ideas, suggestions, proposals, plans, or other materials, whether online, by email, by postal mail, or otherwise (collectively, 'comments'), you agree that we may, at any time, without restriction, edit, copy, publish, distribute, translate and otherwise use in any medium any comments that you forward to us. Except as otherwise required by applicable law, we are and shall be under no obligation (1) to maintain any comments in confidence; (2) to pay compensation for any comments; or (3) to respond to any comments.

We reserve the right, but have no obligation to, monitor, edit or remove content that we determine in our sole discretion are unlawful, offensive, threatening, libelous, defamatory, pornographic, obscene or otherwise objectionable or violates any party’s intellectual property or these Terms.  You agree that your comments will not violate any right of any third-party, including copyright, trademark, privacy, personality or other personal or proprietary right. You further agree that your comments will not contain libelous or otherwise unlawful, abusive or obscene material, or contain any computer virus or other malware that could in any way affect the operation of the Service or any related Platform. You may not use a false e-mail address, pretend to be someone other than yourself, or otherwise mislead us or third-parties as to the origin of any comments. You are solely responsible for any comments you make and their accuracy. We take no responsibility and assume no liability for any comments posted by you or any third-party.

SECTION 12 - PERSONAL INFORMATION

Your submission of personal information through the store is strictly governed by our Privacy Policy, which is incorporated into these Terms by reference. SECTION 13 - PROHIBITED USES

When using the Platform, our Services, or purchasing Products from Pop Mart, you agree to comply with all applicable laws, regulations, and these Terms. You must use the Platform and Services only for lawful purposes and in a manner that does not infringe the rights of Pop Mart, our affiliates, our partners, other users, or any third party.

You agree that you will not:

(a) use the Platform, Services, or Products for any unlawful, fraudulent, or unauthorized purpose, including any activity that violates applicable laws, regulations, or third-party rights;

(b) purchase Products for the purpose of commercial resale, distribution, or other business purposes unless expressly authorized by Pop Mart. Pop Mart reserves the right to refuse or cancel orders that appear to be placed for resale, bulk trading, or other unauthorized commercial purposes;

(c) use automated systems, bots, scripts, crawlers, scraping tools, or other technologies to access the Platform, place orders, bypass purchasing restrictions, collect information, secure Products, or interfere with the normal operation of the Platform;

(d) create, use, or control multiple accounts or provide false, misleading, or incomplete account information for the purpose of circumventing purchase limits, promotional restrictions, account controls, or other measures implemented by Pop Mart;

(e) engage in fraudulent, abusive, or deceptive activities, including but not limited to using unauthorized payment methods, making false claims, requesting refunds for Products not purchased from Pop Mart or not properly returned, returning counterfeit or substituted Products, or otherwise attempting to obtain benefits through dishonest means;

(f) upload, transmit, distribute, or otherwise make available any content that is unlawful, harmful, threatening, abusive, defamatory, discriminatory, obscene, or that infringes the intellectual property, privacy, or other rights of any person;

(g) infringe, misuse, copy, reproduce, modify, distribute, or exploit any intellectual property rights belonging to Pop Mart or any third party, including trademarks, copyrights, designs, trade names, product images, or other proprietary materials, except as expressly permitted by applicable law or with prior written permission from Pop Mart;

(h) introduce viruses, malware, harmful code, or any other material that may affect the security, functionality, or operation of the Platform, Services, or any related systems; or

(i) attempt to gain unauthorized access to the Platform, user accounts, systems, networks, or security features, or interfere with the experience of other users.

You are responsible for all activities carried out through your account and for ensuring that your use of the Platform and Services complies with these Terms. Pop Mart reserves the right to take appropriate action, including restricting access, cancelling orders, or suspending or terminating accounts, where we reasonably believe that these Terms or applicable laws have been breached.

Any breach or violation of the Terms will result in an immediate termination of your Services. You agree that Pop Mart will not be liable to you or to any third party for the termination of your access to the Site as a result of any violation of these Terms.

SECTION 14- OUR PROPRIETARY RIGHTS

The Services are owned and operated by Pop Mart. The materials contained within the Services, including but not limited to all software, design, text, editorial materials, informational text, photographs, illustrations, audio clips, video clips, artwork, other graphic materials, and all names, logos, trademarks, and service marks (collectively, the "Materials"), are derived in whole or in part from materials supplied by Pop Mart and its third-party partners. All such Materials are protected by applicable copyright laws, international treaty provisions, trademarks, service marks, and other intellectual property laws. You agree to abide by all applicable copyright and other intellectual property laws and regulations. You acknowledge that the Services and the Materials have been developed, compiled, prepared, revised, selected, and arranged by us and others through the application of methods and standards of judgment developed and applied through the expenditure of substantial time, effort, and money, and constitute the valuable intellectual property of Pop Mart and such others. You agree to protect the proprietary rights of Pop Mart and all other parties having rights in the Services during and after the term of this agreement. You shall comply with all reasonable written requests made by us or our suppliers and licensors of content (collectively, “Suppliers”) to protect our and others’ contractual, statutory, and common law rights in the Services. You agree to notify us immediately upon becoming aware of any claim that the Services infringe upon any copyright, trademark, or other contractual, statutory, or common law rights. As between you and Pop Mart, all present and future rights in and to trade secrets, patents, copyrights, trademarks, service marks, know-how, and other proprietary rights of any type under the laws of any governmental authority, domestic or foreign, including, without limitation, rights in and to all applications and registrations relating to the Services, shall, at all times, be and remain the sole and exclusive property of Pop Mart. Any unauthorized use of any Materials contained on or through the Services may violate copyright laws, trademark laws, the laws of privacy and publicity, and relevant communications regulations and statutes.

SECTION 15 -  LIMITATION OF LIABILITY

WE AIM TO ENSURE THAT THE SERVICE IS AVAILABLE, SECURE AND FUNCTIONS PROPERLY. HOWEVER, WE DO NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE AT ALL TIMES, OR AVAILABLE WITHOUT INTERRUPTION. FROM TIME TO TIME, ACCESS TO ALL OR PART OF THE SERVICE MAY BE SUSPENDED, RESTRICTED OR UNAVAILABLE DUE TO MAINTENANCE, UPDATES, TECHNICAL ISSUES, SECURITY REASONS, LEGAL REQUIREMENTS OR CIRCUMSTANCES BEYOND OUR REASONABLE CONTROL. THE SERVICE IS PROVIDED ON AN “AS AVAILABLE” BASIS. EXCEPT AS EXPRESSLY SET OUT IN THESE TERMS AND TO THE EXTENT PERMITTED BY APPLICABLE LAW, WE DO NOT PROVIDE ANY ADDITIONAL WARRANTIES, REPRESENTATIONS OR GUARANTEES IN RELATION TO THE SERVICE. SECTION 16 - WAIVER
